These Terms of Service ("Terms") govern your access to and use of the Eli Apps website and the software-as-a-service products we operate (collectively, the "Services"). By accessing or using the Services, you agree to be bound by these Terms. If you do not agree, do not use the Services.
Eli Apps is a software-development company that builds and operates market-vertical SaaS products for small and mid-sized businesses in the United States. References to "we," "us," or "our" mean Eli Apps.
You agree to use the Services only for lawful purposes and in accordance with these Terms. You agree not to:
Some features require an account. You are responsible for safeguarding your account credentials and for all activity that occurs under your account. Notify us promptly of any unauthorized use. You must provide accurate information and keep it current.
Paid plans are billed in advance on the interval you select. Fees are non-refundable except where required by law. We may change pricing with reasonable notice; changes apply to subsequent billing periods. Payments are processed by our payment provider, Stripe, subject to its terms.
The Services, including all software, text, design, and trademarks, are owned by Eli Apps or its licensors and are protected by intellectual-property laws. These Terms do not grant you any right, title, or interest in the Services other than the limited right to use them in accordance with these Terms. Content you submit remains yours; you grant us the limited license needed to operate the Services.
The Services may integrate with or link to third-party services (for example, analytics and payment providers). We are not responsible for the content, policies, or practices of third parties. Your use of third-party services is governed by their own terms and privacy policies.
The Services are provided "as is" and "as available" without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Services will be uninterrupted, error-free, or secure.
To the maximum extent permitted by law, Eli Apps will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or data, arising out of or related to your use of the Services. Our total liability for any claim arising out of these Terms will not exceed the amount you paid us in the twelve months preceding the claim.
We may suspend or terminate your access to the Services at any time if you violate these Terms or if we discontinue the Services. You may stop using the Services at any time. Sections intended to survive termination (including ownership, disclaimers, and limitations of liability) will continue to apply.
Your use of the Services is also governed by our Privacy Policy, which describes how we collect, use, and protect your information.
These Terms are governed by the laws of the United States and the State of Delaware, without regard to conflict-of-laws principles. Any dispute will be resolved in the state or federal courts located in Delaware, and you consent to their jurisdiction.
We may update these Terms from time to time. When we make material changes, we will post the updated Terms and update the "Effective Date" above. Your continued use of the Services after changes take effect constitutes acceptance of the updated Terms.
